Hi guys,
A good friend has contacted me to see if we can help out.
My friends, friend works as a hairdresser in a shop and is exempt from wearing a face-covering due to a disability. She is being told by her employer she has to wear a mask or only do non-contact work or be furloughed!
Does anyone know what we can use to get around this one? Employment law vs exemptions, human rights, equality act etc.
Thanks in advance.
Just a quick update, turns out it's the council that are demanding the mask wearing, if not mask then she can only do non contact jobs!
A family member runs restaurants throughout the country, many of his staff don't wear masks and all they do is fill out a form to say they can't wear a mask and it's put in the health and safety file, job done.
I think we've potentially come across a council 'jobsworth', or maybe just someone who is misinformed and fears they will loose their job if they get it wrong.
I'm thinking it's definitely discrimination and maybe a disability charity could help?
I’m not sure I’m much help, but I do know the police have been round the shops where I go. A chap I know in the charity shop told me they had to approach anyone not in a mask and try to enforce it Even with an exemption. He thankfully knew the rules managed the shop and said no, he knew the government guidelines. The policeman was not happy, but just left.
So I’m thinking are the businesses being pressured? My hairdressers says they are occasionally checked! She hates wearing it.
No one seems to banding together business wise to say no.
Law and Fiction is a good site on understanding the rules.
